This settlement covers hourly-paid, non-exempt workers employed by Fontaine Modification Company between May 1, 2022 and September 1, 2026. The lawsuit claims the company failed to pay for all time worked and left some pay out of the overtime rate calculation, under federal and Virginia wage laws. Fontaine denies wrongdoing. The company agreed to pay up to $1.6 million, from which attorneys' fees and expenses, administration costs, and a service award to the plaintiff are deducted. The remainder is split among eligible workers based on their potential damages and penalties, using company records. Workers in Virginia are included automatically and will be paid unless they opt out. Workers in other states must return a Consent to Join and Claim Form by November 27, 2026 to receive a payment and release their federal wage claims. Doing nothing means no payment for those outside Virginia.
We're not a law firm; the official settlement site has the final word.
