This settlement covers people whose request for single-level lumbar artificial disc replacement surgery was denied by Aetna as experimental or investigational. The denials must fall within a window starting in August 2016 or March 2019, depending on the case, and ending in February 2023, and the coverage had to come from an ERISA-governed health plan insured or administered by Aetna. Three kinds of relief are available. People who already paid out of pocket for the surgery may be reimbursed up to $55,000. People still covered by such a plan who have not had the surgery can submit new coverage requests, which will be decided under the settlement terms. People no longer covered can seek up to $55,000 toward a future surgery if they lack other coverage for it. Claimants must submit a claim form along with supporting documentation. Class lawyers will request up to $2,556,000 in fees and expenses, paid separately by Aetna. Payments will only be made after the court approves the settlement and any appeals are resolved. The page does not list a claim filing deadline.
We're not a law firm; the official settlement site has the final word.
