$1,000,000 PRIZE CONDITIONS/FORM OF PAYMENT: The awarding of the $1,000,000 Prize is subject to verification by Sponsor and Adjuster based on their verification of the Attempt, which may occur after conclusion of the Event. In no event shall Sponsor or Adjuster be responsible for awarding more than one (1) $1,000,000 Prize. If the $1,000,000 Prize is won in the manner described herein, such $1,000,000 Prize will be awarded pursuant to a contingent prize contract between Sponsor and Adjuster (the “Policy”) which may include one or more deferred annuity policies or other funding vehicles or instruments obtained by the Adjuster to fund the prize. The Policy shall provide for payment of the $1,000,000 Prize over 25 years at a rate of $40,000 for each of the 25 years, without interest. The estimated value of such annuity as of May 1, 2013 was $752,846. Under no circumstances will the $1,000,000 Prize, nor the estimated value of the underlying annuity, be available as a lump-sum payment. In the event the $1,000,000 Prize is won, the $1,000,000 Prize winner, on behalf of himself/herself, his/her heirs, executors and assigns, agrees that: (a) Sponsor’s sole liability shall be to assign rights to receive payments under the Policy to the winner of such prize, who shall look solely to Adjuster for payment under the Policy; and (b) the Sweepstakes Entities (other than Adjuster) shall have no responsibility or liability arising out of Adjuster’s failure to perform its obligations under the Policy. If the $1,000,000 Prize is won, Adjuster shall have the right to withhold any amounts required for the payment of applicable taxes. The total present ARV of all prizes offered is $798,446.
