Grand Prize A shall consist of: (a) One (1) seat onboard an XCOR spacecraft, the LYNX Mark II (“Lynx”), currently being assembled, on a date to be determined by XCOR in year 2017, for a flight from a spaceport (location TBD), up to an altitude of approximately 100 kilometers (62 miles); including round trip economy travel and transfers from Winner’s home residence (anywhere in the US) to the spaceport, and economy accommodations near the spaceport (Approximate Retail Value (“ARV”) $100,000.00 USD); and (b) a check made out by Prize Provider to Grand Prize Winner in the amount of fifty thousand US dollars and zero cents ($50,000.00) (the “Check”) ARV $50,000.00 USD). The Check shall be delivered by Prize Provider to Grand Prize Winner within thirty (30) days of the Winner’s final medical exam, or, in the event Winner is found at any time to be ineligible to participate in the Lynx Flight, within thirty (30) days of such determination, and in any event on or before December 31, 2017. Prize Provider shall provide XCOR with Winner’s contact information and XCOR will contact Winner. XCOR will be the Prize service provider and handle all future communications with Winner regarding Lynx flight including XCOR Clearance set forth below. Assignment of a flight slot number occurs when potential Winner completes the XCOR Informed Consent Liability Waiver Agreement and other XCOR Clearance obligations set forth below and/or provided by XCOR. The Check shall be issued within Prize Winner has completed the notarized Affidavit of Eligibility/Liability/Publicity Release. Although Lynx is presently under construction, Entrant recognizes that the Lynx must receive United States Federal Aviation Administration (FAA) approval for commercial suborbital space travel prior to flying the flight contemplated hereunder. Entrant also recognizes that space tourism is a new, ever-evolving industry. As the industry evolves, certain rules, regulations and laws may materially alter XCOR’s ability to provide this service. Total ARV of Grand Prize A is one hundred and fifty thousand dollars and zero cents ($150,000USD).
Grand Prize B shall consist of: a check made out by Prize Provider to Grand Prize Winner in the amount of seventy five thousand US dollars and zero cents ($75,000.00). Total ARV of Grand Prize B is seventy five thousand dollars and zero cents ($75,000 USD).
