Grand Prize: (1 winner) Trip to New York City for winner and one (1) guest for a consultation with a nutritionist. Trip date will be determined solely by Sponsor, which will provide winner with a choice of travel dates during the weeks of December 2 or December 9, 2009. Winner must be available to travel on one of Sponsor’s pre-selected dates or prize will be forfeited and, at Sponsor’s discretion, an alternate winner will be chosen. Prize includes: round-trip coach air transportation to New York City for winner and guest from a major U.S. gateway airport closest to winner’s US residence (as determined by Sponsor), a two (2) day, one (1) night stay at a hotel selected by Sponsor (standard room, double occupancy), one (1) continental breakfast for winner and guest, and personalized services (“services”) of nutritionist Adria Rothfeld-Magenheim (“nutritionist”). Services include pre-consultation work to be completed and returned by winner and guest prior to trip and a two (2) hour consultation with winner and guest. Pre-consultation work, consisting of a Nutritional Questionnaire and 3-day food diary, is designed to provide nutritionist with information about winner’s typical diet and lifestyle. The Nutritional Questionnaire and food diary will be used for no purpose other than by the nutritionist to aid in providing the consultation. Consultation with nutritionist will include: a personal analysis using a Biomarkers 2000 Body Scan Analyzer (“analysis”), a portable, battery-powered bioimpedance device that uses standard electrocardiogram sensor pad electrodes to measure (including but not limited to) body mass index, basal metabolic rate and fat mass. Analysis requires specific preparation: no alcohol consumption within 24 hours prior to taking the test, no exercise, caffeine or food within 2-3 hours prior to taking the test, and the consumption of 2-4 eight ounce glasses of water 2 hours prior to taking the test. The analysis is not appropriate for persons who are pregnant, persons with any implantable electronic device (including pacemakers) or persons with diagnosed heart problems. Analysis results will be discussed by nutritionist and available for winner to take home. Analysis is optional. Winner understands that he/she should consult with his/her doctor prior to undertaking any new exercise, nutrition or other health plan or routine. Sponsor does not in any way endorse the nutritionist or any advice provided by the nutritionist. Winner agrees to release and hold harmless Released Parties (as defined below) from any loss, claim or liability associated with the consultation with the nutritionist and/or any advice provided by nutritionist. Ground transportation will be provided between hotel and consultation and between airport and hotel. If winner resides within a reasonable distance of New York City as determined solely by Sponsor, Sponsor reserves the right to substitute ground transportation for air transportation and no compensation will be provided for difference in prize value. Winner and guest must travel together on the same itinerary and are responsible for obtaining all necessary travel documents. All travel arrangements must be made through Sponsor’s agent and on a carrier of Sponsor’s choice. Guest must be of legal age of majority in his/her state of residence (and at least 18) unless child or legal ward of winner. Guest (or, if a minor, winner) must execute and return a liability/publicity release prior to travel. All costs and incidentals associated with prize acceptance and use not specified herein as being provided, including but not limited to phone calls, additional meals and beverages, luggage fees, ground transportation entertainment, souvenirs, and any and all applicable taxes are responsibility of winner. Travel is subject to availability and other trip conditions and restrictions. Estimated Retail Value (“ERV”) of Grand Prize is $3500.00. Actual value may vary based on point of departure and dates of travel. If Sponsor is unable to provide the consultation with the nutritionist due to winner’s medical condition or otherwise, no compensation or substitution will be provided; however, remainder of prize package will be awarded and Sponsor will have no further obligation to winner.
