Daily Prizes:
Sponsor has reserved twenty-eight $25 Shop Etc. Mall Gift Cards to be awarded to one person after each of the Daily Promo-Dates.
The total Approximate Retail Value (“ARV”) of all prizes awarded is $11,846.88.
The following restrictions apply to the Grand Prize winner’s vacation getaway: Airfare may not exceed $800 per ticket. All tickets and hotel stay will expire by or before one year from the date prize is awarded to winner. Restrictions apply including expiration dates and blackout dates for hotel stay and travel. Winner is responsible for any costs/expenses not specifically listed above including, but not limited to, taxes, meals, drinks, insurance, airport transfers not stated, car rentals, taxi, gratuity, baggage fees, communication charges, and all personal expenses and incidentals. The Sponsor or its’ prize provider determine the hotel room and air travel, this determination is based on availability and is not negotiable. All gift certificates and gift cards are subject to the terms and conditions of the gift card issuer, including service fees. Hotel stay and travel must be used prior to expiration date, any unused portion of the prize will be automatically forfeited. Winner must make arrangements directly with Sponsor’s prize provider, Sponsor will provide all applicable information for the winner to correspond with Sponsor and its’ Agents concerning prize redemption details. Once booking is finalized, no deviations will be allowed for any portion of the prize. The Grand Prize must be accepted as awarded and may not be sold or transferred and is not convertible to cash. Sponsor or its’ Agents reserve the right to require additional documentation from winner and their guest. Additional prize restrictions and terms may be imposed by prize providers. The Sponsors reserve the right to substitute a prize in whole or in part in the event that all or any component of the Grand Prize is unavailable. All properly claimed prizes will be awarded. All travelers must possess required travel documents. Grand Prize Winner’s guest, if any, must be 18 or under the legal guardianship of the Grand Prize Winner, and travel on the same itinerary. The actual retail value of the Grand Prize may depend on Winner’s point of departure/return, winner will not receive compensation for any difference between actual value and stated value. Other restrictions may apply. Prizes consist only of those items specifically listed. All prizes are awarded without warranty, express or implied, of any kind. Sponsor reserves the right to substitute a prize with a prize of equal or greater value.
Winners of the Sweepstake Prizes will be selected in a random drawing held on or about June 22, 2012. Winners of the Daily Prizes will be selected in a random drawing held after the Daily Promo Date and within 4 days of the close of the Promotional Period.
Claiming Prizes: Winners of the Daily Prizes will receive the gift card in the U.S. Mail or via a reputable carrier. Daily Prizes will be shipped within two (2) weeks of the end of the Promotional Period. Winners of the Sweepstakes Prizes will be notified by email, text, or phone and each unverified Sweepstake Prize winner must provide Sponsor with a valid email address, via email, within 7 days of the first notification attempt made by the Sponsor or the prize will be forfeited and an alternate winner selected. Winners of the Sweepstake Prizes will be required to sign and return an Affidavit of Eligibility & Liability and Publicity Release (“Release”) & W9 form which must be received by Sponsor or its agent within 10 days of the date it was emailed or the prize will be forfeited and an alternate winner selected. Return of any prize notification as undeliverable will be forfeited and an alternate winner will be selected. PRIZE, APPROXIMATE RETAIL VALUE (“ARV”) AND ODDS OF WINNING:
A. May 21 Grand Prize (1): The one (1) May 21 Grand Prize Winner will receive a five (5) day/four (4) night trip to Paris, France for the May 21 Grand Prize Winner and up to three (3) of his/her guests (each a “Guest”), to visit the MAKE UP FOR EVER Academy (the “Trip”). The Trip will consist of roundtrip coach-class air transportation for Winner and each of his/her Guests from the international airport closest to Winner’s home (selected by the Sponsor in its sole discretion) to Paris, France; four (4) nights hotel accommodation in Paris (two rooms, double occupancy each) at a hotel selected by Sponsor in its sole discretion; round-trip ground transfers between the airport and hotel in Paris; $1,500 for meals, awarded as a check payable to the May 21 Grand Prize Winner; a visit to the MAKE UP FOR EVER Academy in Paris (subject to availability); selected lip products from the MAKE UP FOR EVER Rouge Artiste Intense and Rouge Artiste Natural lines (exact product and shades selected by Sponsor in its sole discretion); and a signature MAKE UP FOR EVER train case. The May 21 Grand Prize Winner and his/her Guests are responsible for all in-room charges (e.g. mini-bar, movies), telephone calls, meals, beverages, gratuities, upgrades, personal incidentals, amenities, and any other fees and expenses not specifically mentioned in these Official Rules. The Winner will be required to provide a major credit card upon hotel check-in and all in-room charges will be charged to the credit card. Furthermore, the Winner and Guests shall be solely responsible for payment of any and all applicable federal, state, and local taxes for the Trip.
Each Guest must be at least eighteen (18) years old or the minor child/ward of the Winner. The Guest must also sign a Liability & Publicity Release. If a Guest is not the age of majority in his/her state of residence, then the Release must be signed by the Guest’s parent or legal guardian.
Travel is subject to the restrictions and conditions set forth below. All Grand Prize-related travel arrangements will be administered by Sponsor’s authorized designee. All travel must be booked at least 30 days prior to departure. Grand Prize travel is subject to capacity controls, availability, weather, seasonal influences, and certain other restrictions, all of which are subject to change. The May 21 Grand Prize Winner and his/her Guest will be required to travel on identical itineraries including the same departure date and return date. Air transportation and hotel accommodations must be taken together and cannot be
taken separately. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. Sponsor will not pay for or obtain any travel insurance. All airline tickets issued in conjunction with a Grand Prize are not eligible for upgrades, frequent flyer miles or any other promotional benefit. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates or similar items once they are in the May 21 Grand Prize Winner’s possession or in the possession of the Guest. Travel must be roundtrip. Sponsor will determine flight itinerary in its sole discretion. Once hotel and flight arrangements have been confirmed, no changes will be allowed except by Sponsor in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules and those set forth by Sponsor’s air travel prize supplier, as detailed in the passenger ticket contract issued by such supplier. If the May 21 Grand Prize Winner elects to travel or partake in Trip with no Guest or less than three (3) Guests, no additional compensation will be awarded to the May 21 Grand Prize Winner.
The Trip is valid 12 months from Winner verification, and will be based on availability.
The Winner and Guests are solely responsible for obtaining any desired or necessary travel documents, travel insurance or any other form of insurance desired (and at their own expense). The May 21 Grand Prize Winner and Guests are solely responsible for passports or any other documentation involved in travel in or to France and must have no impediment to entering or traveling to France or returning to the United States. Winner and Guests hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the Trip. It is the responsibility of each Winner and his/her Guests to arrive at the designated gateway airport in time for each flight that is part of the Trip.
The MAKE UP FOR EVER Academy visit has no retail value. If the MAKE UP FOR EVER Academy visit portion of the Trip is postponed or cancelled for any reason, then the Sponsor shall have no further obligation to the May 21 Grand Prize Winner beyond supply all other portions of the Trip and all other Grand Prize elements.
Check and Product prizes will be sent to May 21 Grand Prize Winner’s residence within 6 to 8 weeks of verification.
B. Total ARV of the May 21 Grand Prize: $12,090.
